Terms of Service

These Terms of Service ("Terms") govern your access to and use of HomeReel, operated by Mi Assist Studio LLC ("we," "us," or "HomeReel"). By creating an account or using the service you agree to these Terms. If you do not agree, do not use HomeReel.

1. Service Description

HomeReel is a software-as-a-service (SaaS) platform that lets real estate professionals upload listing photos and receive AI-generated cinematic videos for use in marketing, social media, and MLS listings. The service is available on the web at homereel.app and through the HomeReel iOS application.

2. Account Registration and Acceptable Use

You must be 18 years of age or older to create an account. By registering you confirm you meet this requirement.

You agree not to:

  • Upload photos you do not own or do not have rights to use commercially.
  • Upload photos of properties you do not have authorization to market.
  • Use HomeReel to generate content that is illegal, defamatory, or violates any third party's intellectual property rights.
  • Attempt to reverse engineer, scrape, or extract the underlying AI models or platform infrastructure.
  • Resell or sublicense access to HomeReel without written permission.
  • Use automated tools to create accounts, submit generations, or abuse the platform in ways that degrade service for other users.

We reserve the right to suspend or terminate accounts that violate these rules, without refund.

3. Billing

Web subscriptions (Stripe)

Subscriptions purchased on the web are billed every 4 weeks (13 billing cycles per year) via Stripe. Subscriptions renew automatically at the end of each cycle. You can cancel at any time from your account settings, and your access will continue through the end of the current paid period.

iOS subscriptions (Apple)

Subscriptions purchased through the iOS app are processed by Apple and are subject to the Apple Media Services Terms and Conditions. Apple handles all billing, renewal, and cancellation for iOS purchases. iOS subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period via your Apple ID subscription settings.

Pay-per-listing

Individual listing generation credits purchased on the web are processed via Stripe. Credits do not expire.

Price changes

We will notify you by email at least 14 days before any subscription price increase. Continued use after the effective date constitutes acceptance.

4. Refunds

Web (Stripe) refunds

We offer a 7-day refund on unused subscription periods at our discretion. To request a refund, email fahim@miassist.ai within 7 days of your charge. Refunds are not available for pay-per-listing credits that have been consumed.

iOS (Apple) refunds

All iOS purchase refund requests are handled exclusively by Apple. We have no ability to issue refunds for App Store purchases. To request a refund, visit reportaproblem.apple.com.

5. Content Ownership

You retain full ownership of the photos you upload and the videos we generate from them. We claim no copyright or ownership over your content.

By uploading photos, you grant Mi Assist Studio LLC a limited, non-exclusive, royalty-free license to store, process, and transmit your photos solely for the purpose of generating your requested videos and delivering the service. We do not use your photos or videos for model training, advertising, or any other purpose without your explicit written consent.

You are responsible for ensuring you have the rights to upload and use any photos you submit to HomeReel.

6. Prohibited Conduct

In addition to the acceptable use rules in Section 2, you may not:

  • Interfere with or disrupt the integrity or performance of the service.
  • Attempt to gain unauthorized access to any account, system, or network.
  • Use the service in any manner that violates applicable law, including fair housing regulations.
  • Impersonate another person or misrepresent your affiliation with any entity.
  • Transmit viruses, malware, or any code designed to harm systems or data.

7. Disclaimer of Warranties

HomeReel is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that AI-generated videos will meet any specific quality or format standard for any particular use case. Real estate marketing results depend on many factors outside our control.

8. Limitation of Liability

To the maximum extent permitted by law, Mi Assist Studio LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of HomeReel, including but not limited to lost profits, lost data, or loss of business opportunities.

Our total liability to you for any claim arising out of or relating to these Terms or the service will not exceed the amount you paid to HomeReel in the 90 days preceding the claim.

9. Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws principles. Any dispute that is not resolved through arbitration (see Section 10) will be brought exclusively in the state or federal courts located in Brevard County, Florida.

10. Dispute Resolution

Informal resolution first

Before filing any formal legal claim, you agree to contact us at fahim@miassist.ai and give us 30 days to resolve the issue informally.

Binding arbitration

If we cannot resolve the dispute informally, both parties agree to resolve it through binding individual arbitration under the American Arbitration Association (AAA) Consumer Arbitration Rules. Arbitration will take place in Brevard County, Florida, or by videoconference at your election.

No class actions

You waive any right to participate in a class action lawsuit or class-wide arbitration against HomeReel or Mi Assist Studio LLC. All disputes must be brought on an individual basis.

Small claims exception

Either party may bring a qualifying claim in small claims court instead of arbitration.

11. Termination

You may close your account at any time via Settings → Delete Account. We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if required by law. Upon termination, your right to use the service ends. Sections 5, 7, 8, 9, and 10 survive termination.

13. Updates to These Terms

We may update these Terms from time to time. Material changes will be communicated by email at least 14 days before they take effect. The "Last updated" date at the top reflects the most recent revision. Continued use of HomeReel after the effective date constitutes your acceptance of the updated Terms.
